These Terms and Conditions (“Terms”) govern your access to and use of our platform, website, services, and WhatsApp Business API solutions. By accessing or using WHATSAPP API MSG BUSINESS, you acknowledge that you have read, understood, and agreed to be bound by these Terms. ________________________________________ 1. User Responsibilities • Users must use the WHATSAPP API MSG BUSINESS platform strictly for lawful, ethical, and permitted purposes. • Users must comply with all applicable local, national, and international laws, anti-spam regulations, and Meta’s WhatsApp Business Policies at all times. • Any misleading, fraudulent, abusive, deceptive, or spam-related activities are strictly prohibited. • Users are solely responsible for ensuring that their content, messages, and campaigns do not infringe upon any third-party rights, including intellectual property and privacy rights. ________________________________________ 2. Account Security • Users are responsible for maintaining the confidentiality of their login credentials and securing access to their accounts. • WAMB shall not be liable for any loss, damage, or unauthorized activity resulting from user negligence. • Users must immediately notify WAMB of any unauthorized access, security breach, or suspicious activity related to their account. ________________________________________ 3. Payments and Billing • Users agree to pay all applicable subscription fees, usage charges, or service fees in accordance with the selected plan. • Failure to make timely payments may result in service suspension or permanent account termination. • All payments made are non-refundable unless explicitly stated otherwise under a separate refund policy. ________________________________________ 4. Data Protection & End-User Consent • Users must obtain clear, lawful, and verifiable consent from end-users before sending any WhatsApp communications. • Users must comply with applicable data protection and privacy laws, including but not limited to GDPR, the Information Technology Act, 2000, and the DPDP Act, 2023. • WAMB processes user and end-user data solely for service delivery purposes, in accordance with our Privacy Policy. • Users are prohibited from uploading, storing, or processing unlawful, harmful, or sensitive personal data without proper consent and legal authorization. ________________________________________ 5. Compliance with Meta Policies • Use of WAMB services requires full compliance with Meta’s WhatsApp Business Platform Policies. • Meta reserves the right to restrict, suspend, or permanently block WhatsApp Business API access for policy violations. • WAMB shall not be held responsible for any actions, restrictions, or enforcement measures taken by Meta. ________________________________________ 6. Service Availability • WAMB strives to maintain high service availability; however, interruptions may occur due to scheduled maintenance, Meta platform outages, WABA provider issues, or external dependencies. • WAMB shall not be liable for service disruptions or losses caused by circumstances beyond its reasonable control. ________________________________________ 7. Platform Abuse & Termination WAMB reserves the right to suspend or permanently terminate user accounts, without prior notice, if: • Illegal, abusive, or unethical activities are identified • Chargebacks, payment fraud, or financial misuse occur • Spam complaints or policy violations are reported Terminated accounts are not eligible for refunds. ________________________________________ 8. Limitation of Liability WAMB shall not be liable for any indirect, incidental, special, or consequential damages arising from: • WhatsApp account suspension or blocking • Policy enforcement actions by Meta • Failures of third-party infrastructure or services • User errors, misuse, or non-compliance with policies ________________________________________ 9. Modifications to Terms WAMB reserves the right to modify or update these Terms at any time.
